Lead-Based Paint Disclosure

Below is the exemption statement from the EPA website regarding the Lead Disclosure Rule. The only limiting factors are age (built in 1978 or later), or use (no bedrooms or housing for elderly with no children under age 6 allowed to live there). Any houses not meeting these requirements must have a Lead-Based-Paint Disclosure, regardless of the type of sale or if the seller ever occupied the property.

Q: Are there any exemptions to the Lead Disclosure Rule?

A: Yes.  If the residential unit being leased or purchased is a zero bedroom dwelling, if it is housing for the elderly (and no children under age 6 reside there), or if the unit has been certified as "lead-based paint free" by a certified lead-based-paint inspector or risk assessor, then the Lead Disclosure Rule does not apply.
