Listing Exclusions
What is a listing exclusion and how to execute one
When sellers ask to exclude someone from the listing contract, this can be done by either writing it into the listing contract or by using the listing agreement changes addendum.
The language used for exclusions varies depending upon the circumstances and what you are trying to accomplish. Here are some examples:
Total Exclusion
"John Doe, Jane Smith and Fred & Wilma Flintstone are
excluded from the terms and conditions of the listing
Agreement for 30 Days."
Reduced Commission
"If John Doe, Jane Smith and Fred & Wilma Flintstone purchase the property, the commission will be X%."
Miscellaneous Costs
"John Doe, Jane Smith and Fred & Wilma Flintstone are
excluded from the terms and conditions of the listing agreement.
Should any excluded party purchase the property, the seller shall
pay Key Realty $XXX for advertising and other expenses."
